In our earlier Circulars No. 111 and 112, we have dealt with the revised rate of Family Pension based on the 11th Bipartite Settlement as approved by the Government. Units are aware that under this Settlement, Family Pension is now payable ( w.e.f. 1-4-2021) at uniform rate of 30% of Pay without any ceiling and DA thereon.
Units are also aware that in terms of Regulation 39 of Pension Regulations, family pension is payable at the double the ordinary rate with a maximum of 50%.
Pension Regulation 39 – To whom applicable ?
Applicable to family of the employees who die while in service.
What is Regulation 39 ?
In terms of Pension Regulations 39(3)(a)(i), if an employee (who is not governed by the Workman’s Compensation Act), DIES WHILE IN SERVICE, after having rendered not less than 7 years service the rate of family pension payable to the family shall be equal to 50% of the pay last drawn or twice the family pension admissible whichever is less.
This higher amount of family pension is payable for the next 7 years from the date of death of the employee or upto the date on which deceased employee would have attained the age of 65, whichever is less.
(Note: After this period of next 7 years or 65 years of age of the deceased whichever is earlier, the Family Pension will be payable at 30% of the Pay i.e. at the ordinary rate)
All the existing cases of Family Pension paid to the family pensioners under Regulation 39 (those who died in service on or after 1-5-2014) will be eligible to be revised now from 1-4-2021.
